The paper examines the dispute between garantists and publicists regarding the evidentiary powers of the judge. We review the critique that associates such faculties with unacceptable political systems, criticizing and nuancing it, while trying to rescue some of Franz Klein's ideas. Then, we examine the relationship between truth as the end of the process and the publicist positions, on the one hand, and garantist on the other. The publicist arguments about the relation between truth and justice are rejected, although the idea that the garantism can not completely discard the role of the truth in the process is defended, because it is necessary for the social peace and the enjoyment by the individuals of the benefits of the existence of courts. Related to this idea, attention is drawn to certain similarities between the ideas of Klein and Gordon Tullock. It concludes with a call for attention on certain areas of arbitrariness on which garantists and publicists should worry about. ; El trabajo examina la disputa entre garantistas y publicistas respecto de las facultades probatorias del juez. Se revisa la crítica que asocia tales facultades con sistemas políticos inaceptables, criticándola y matizándola, a la vez que tratando de rescatar algunas ideas de Franz Klein. Luego se examina la relación entre la verdad como fin del proceso y las posturas publicistas, por un lado, y garantista por el otro. Se rechazan los argumentos publicistas sobre la relación entre verdad y justicia, aunque se defiende la idea de que el garantismo no puede desechar completamente el rol de la verdad en el proceso, pues es necesaria para la paz social y el goce por parte de los individuos de los beneficios de la existencia de tribunales. A propósito de esto se llama la atención sobre ciertas similitudes entre las ideas de Klein y Gordon Tullock. This work analyzes the itinerary for constitutional change that President Michelle Bachelet recently announced. Along with a presentation of the process, this work critically assesses some of its stages. It mainly contends that the set of institutional regulations it assumedregulations that were taken from current constitutional rulesmakes it impossible to talk, at least from a theoretical perspective, of a genuine constituent process. This work also offers a democratically adequate reading for the process, so that it will make possible a dialogue between the current institutions sought to be replaced and the mechanism for constitutional change, without subjecting the latter to the former. ; El presente trabajo analiza el itinerario de cambio constitucional propuesto por la Presidenta Michelle Bachelet. Junto con una descripción del mismo, se discuten, críticamente, varias de sus etapas. En lo principal, se objeta el conjunto de cerrojos institucionalmente vigentes que harían imposible, al menos desde una perspectiva teórica, hablar de un proceso genuinamente constituyente. El trabajo ofrece, al mismo tiempo, una lectura democráticamente adecuada para que el proceso permita un diálogo entre la institucionalidad que se pretende abandonar y el mecanismo con el que se busca el cambio constitucional, sin que las primeras limiten al segundo.
